The insured company was an authorised reseller of computer products manufactured by a US company. The US company issued proceedings against the company and its managing director in relation to the alleged purchasing and selling of their products in the European Economic Area (“EEA”), which were not put on the market within the EEA by the US company or with its consent. The claimant further alleged that the defendants infringed its trademark. Defence costs paid amounted to £107,109 – no territorial exclusions applied.
